Bribery in Criminal Law - [法律那些事儿]

The legislative branch in China is planning to rise the criminalized amount of money for bribery since it is unjustified and unacceptable that some cases over 5000 yuan were indicted by prosecutors and had been found guilty but others were not, said Zhang Jun, the vice-president in China’s Supreme Court, when he was giving a lecture in the Law School of China Renmin University.
This is interesting. Scholars argued that the criminal law has granted privilege to public officials that they can be bribed more money once the criminal law was amended. It was 1000 yuan before 1979, 2000 yuan after 1988 and 5000 yuan from 1997.
I am puzzled why it has to be fixed in amount of bribery in criminal code? Does it too arduous for legislative officials to determine that the economic condition is progressing in modern China? Whether or not, referring to provisions of criminal code in other countries or consulting their counterparts when they are making laws in China? If I were, I would have done as I mentioned.
To clear my puzzlement, I surfed on the Internet for a long time this morning. Thanks to the wonderful modern technology, World Wide Web brings an endless supply of information on this theme. The criminal codes (penal codes) in various countries I have found have not the stipulation of criminalized amount for bribery. Besides, something related is also very interesting. I am honor of presenting some of them as follows:
First is Australian criminal law. Its Commonwealth Criminal Code Act 1995 141.1.3 reads: A Commonwealth public official is guilty of an offence if: (a) the official dishonestly: (i) asks for a benefit for himself, herself or another person; or (ii) receives or obtains a benefit for himself, herself or another person; or (iii) agrees to receive or obtain a benefit for himself, herself or another person; and (b) the official does so with the intention: (i) that the exercise of the official's duties as a Commonwealth public official will be influenced; or (ii) of inducing, fostering or sustaining a belief that the exercise of the official's duties as a Commonwealth public official will be influenced. Penalty: Imprisonment for 10 years. Benefit includes any advantage and is not limited to property.
It has several merits. First, it is clearly interpreted the crucial term benefit, including any advantage but not limited to property, which certainly includes behavior like sex, haha. Second, it defines the criminal behavior as “asks for”, “receive or obtain” or “agree to receive or obtain” with the intention of public officials’ duty influenced, clearly and explicitly. Third, its penalty is also no choice, 10 years imprisonment, without judicial discretion.
Second is American criminal law. Title 18 of the United States Code is the criminal and penal code of the federal government of the U. S. It deals with federal crimes and criminal procedure. Its article 201 is for briery of public officials and witness. In part (a), it defines the term “public official” “person who has been selected to be a public official” and “official act”. In part (b), it lists behaviors of bribery: (2) being a public official or person selected to be a public official, directly or indirectly, corruptly demands, seeks, receives, accepts, or agrees to receive or accept anything of value personally or for any other person or entity, in return for: (A) being influenced in the performance of any official act; (B) being influenced to commit or aid in committing, or to collude in, or allow, any fraud, or make opportunity for the commission of any fraud, on the United States; or (C) being induced to do or omit to do any act in violation of the official duty of such official or person.
That is good. To receive or accept anything of value is necessary for bribery. Then demanding, seeking, receiving, accepting, agreeing to receive or accept are all included. The last but not least, influenced or induced to do or omit any act in violation of the official duty is integral condition for bribery, not ambiguous.
Third is the Great British criminal law. It says that the jurisdiction of England and Wales does not have a Criminal Code though such an instrument has been often recommended and attempted. As of April 2009, the Law Commission is again working on the Code, haha.
Then comes Japanese criminal law. Article 197 of its criminal code reads: a public officer or arbitrator who accepts, solicits or promises to accept bribe in connection with his/her duties shall be punished by imprisonment with work for not more than 5 years; and when the officer agrees to perform an act in response to a request, imprisonment with work for not more than 7 years shall be imposed.
This is similar to Chinese criminal law, ambiguous and obscure.
The last, criminal code of Russian Federal. It is said that we Chinese has copied their legal system as well as laws from this country. Article 290 of its criminal code is for bribe taking. It classifies bribes for legal and illegal actions with different punishments, from fine to imprisonment.
For the foreign criminal codes I have read, the imprison punishments are lower than it in China, which imposes death penalty in its highest for bribery. However, almost all bribery criminalists with large amount of money have escaped death penalty, and even worse, some of them are found of innocent eventually. What else can our legislative branch do if criminalists deserve their right to death?

最近比较懒。两个原因:一是我的办公室室内温度只有九度,以一个正常心理的普通人的耐力,我很难坚持在这样的办公条件下坚持一整天而不觉得冻手腿以及所有不能有效遮盖的部位。二是我的LP的右眼患了一个不大不小的毛病。
10月18日晨,LP感觉右眼眼睑内侧似乎有点肿。出于对心灵窗户的重视,一大早去承德市最牛的附属医院挂了眼科专家号,由一位姓X的专家接诊。
到眼科看病的惯例是先查视力,辅诊的大夫给查了查,LP的视力是一如既往的好,两个眼睛均为1.0。
然后专家看了看,说没什么大事,观察观察吧,随后开了两瓶眼药水,合计100元。
10月21日,LP感觉出毛病的位置有所扩大,而且鼻子右侧起来三个小水泡,所以又去看。心想着再挂个专家号,让另一位专家看看。可没想到的是,这次接诊的还是上次那个X专家。
专家又看了看,并且用仪器检查下。
LP问:我的眼睛是什么毛病?专家说:不好说,象是虹膜炎,看着没什么事。
又问:容易治愈吗,多长时间能好?答:看看吧,说不好多长时间。
问:眼角的水泡好象破了。答:象针眼,不过也不象,针眼有根儿,你这个没根儿。
问:脸上的水泡是怎么回事?答:那个你去皮肤科看看吧!
问:不会有什么大毛病吧?答:这个不好说。
于是又开了两瓶眼药、两种口服药,合计260元。
10月23日,星期五下午,LP发现自己右眼视物不清,而且感觉有点右侧头晕。于是又去医院。心里想着这次换个医生看吧,挂个普通号。到诊室一看,还是那位X医生。X医生笑着说:今天偶出普通诊。
例行检查,LP的左眼视力还是1.0,右眼视力已经降到了0.4 。
接诊医生刚看了一眼,就说:你这个可严重了,不象前两次来的情况了。
LP紧张地问:怎么,严重了?医生说:严重了,角膜上有斑点,视力明显下降,角膜上皮可能有损伤。
LP更紧张了:这样会不会影响视力,还能恢复吗?医生说:这个不好说。
最后医生在病例上不再写“诊断如前”,而是改成了“角膜上皮质病变”。又开了两种眼药水两种口服药,220元。
从医院出来,LP焦急地打电话给我,我说不行咱去市医院再看看吧!
于是打车到市医院,正好碰见个熟人,领着到眼科,接诊的是一个年轻医生。
医生听完患者描述病情,说:你头晕,是不是眼压高啊?测个眼压吧!
不测不要紧,这一测,眼压还真高。医生分析说:眼压高,脸上的水泡是泡疹,怀疑你是青光眼。先开一瓶降眼压的药水,十二个小时点一次,明天上午再来复诊。降眼压的药水一瓶2.5元。
LP回来更加担心了,想想自己好么样的眼睛,怎么一下子就青光了呢?担心不好治了,担心会失明,还担心视力不可恢复,更担心会影响左眼,一夜基本无眠,盘算着去北京同仁医院检查。我说,咱再去附属医院找张主任看看吧。
10月24日早上六点,我到附属医院挂眼科主任的号。据说这眼科张主任牛的很,他看的病基本上到同仁也是同样结论。从六点到七点,七点五分才开始挂号,那叫一个冷啊。
张主任的检查果然相当专业,LP说,和X大夫那就不是一个档次的。
LP描述了X大夫给检查诊断的过程。张主任对他的助手说:你去把X大夫叫过来。X大夫过来后,张主任让她看了看,然后告诉她什么什么的,X大夫不情愿地离开了诊室。
张主任的最后诊断是青睫综合症。
张主任说:诊断你为青睫综合症的理由是你的眼压高,视物不清,角膜有损伤,有瞳闪,也有KP。不过这个毛病的治疗不成问题,视力也能恢复,不会影响左眼,只是需要的时间长一点。
LP说:要是先找您看就好了,不至于耽误我病情。张主任说:病情是发展的。
开了三样眼药水,一种抗病毒的口服药,叫阿昔洛维。合计232元。
LP还是不放心,又找熟人引见,托市医院退休后被铁路医院聘用的郝主任看了看,诊断如张主任。而且用了张主任开的药后,症状也确实减轻了,LP这才放了心。
10月31日,LP又去附属医院复诊,张主任的助手马医生给做了检查。视力已经恢复到0.6 ,其他各项指标也有所好转,马医生又给开了一种散瞳的眼药水,说是同时用可以加快恢复的速度。
这次去医院,我才有机会观察诊室的情况。呵呵,从医生开药方用的笔,到便签纸、喝水杯、搁物架,甚至医生用来放眼压对数表的塑料套,无一不印着药品名字或者制药厂家的名字。无怪乎医生喜欢开效果相同但价钱不同的提成药哦。
其实这中间还看过一次中医,开了四副中药。直到现在,LP也没有完全断了去同仁的念头。
近年来,生物--心理--社会的新医学模式备受推崇,其实说到底,说是把病人当人看。我常对我们庭的法官说,不要求你们把当事人当成是亲人,只要求你们对当事人多一点同情心,设身处地的为当事人想一想,尽最大可能减少他们的诉讼成本。其实医生也是一样,如果要求医者父母心,实在是有些难为他们,但医生尽量多一点同情心,还是完全可以办得到的。
最近在看一本苏力老师翻译的波斯纳的新书《法官如何思考》。波老师是法律经济学的鼻祖,苏力老师翻译的也算顺畅。波老师在书里常把法官比医生,说他们开发了一种神秘,夸大了职业的非私利性,用深奥的材料和技巧无私地建造了不为任性、政治或无知玷污的教义大厦。职业的神秘性让外行人很难评估他们是否提供了关键服务。说得真好。
前两年我女儿嗓子疼,附属医院的专家开了输液的方子,同时要求每天做次雾化。我们考虑这个事情被医生处理的太复杂了,在女儿的老姨的建议下,买了一盒黄氏响声丸,花了13元左右,只吃了两天,女儿的嗓子完全好了。
当时我就想:如果作为患者的我女儿,是开药的专家的孩子,她还会那样治疗吗?

机关篮球赛结束了,我们队荣获第三名。
总体感觉,各队队员年龄偏大,大概平均也在四十五岁左右,有的队达到五十二三岁,这也从一个侧面反映出法官老龄化问题很严重。
由于第一次举办这样的重大赛事,平时同志们缺乏训练,体力不支,配合不好,技术不佳,所以好多场比赛除了好多次笑话,场上场下倒是也挺热闹的。
不过,因为大家跑不起来,在我看来,篮球赛不如叫懒球赛。

从本周四开始,本院将利用四至五个下午时间开展首次机关篮球比赛。
参赛球队以支部为基础组合为两组八队,每组四队。组内进行循环赛,以积分最高者出线,进行冠亚军争夺赛。大概是这意思,因为我不懂篮球,我除了地球略知一二以外,其他什么大球小球一概不懂,也从来没兴趣去玩。
法院机关举行这次篮球赛,得到各支部的大力支持,各部门同志踊跃报名,仅半天时间就完成了规定两天时间完成的报名任务。机关为参赛队员准备了两套运动服,提供了矿泉水,并专门请来马上就要升本的承德师专体育老师担任主副裁判。
因为赛场上既有拉拉组成的队伍的喝彩声,又有美美组成的方阵在助威,所以比赛活动进行的有声有色,声色都十分厉害。所有的男队员都在勇敢地拼抢,所有的女队员都在躲避着男队员的猛烈撞击(因为女同志太少,所以没有组成两个女队,所以规则是,如果有女队员参加且坚持半场以上的,在总分中加上二分),所以现场那是一个热闹额。
我个人认为,法院机关搞点这样的文体活动,8错。活跃机关气氛,密切同志关系,提高工作效率,有利身体健康。而且法院干部明显年龄偏大,这样一来,还能让自己和人们感觉到有点生气。

趁着省院领导休息的功夫,我忙里偷自己的闲到楼下常去那家理发店修理一下头上的地球。
这三十多岁的女人,在理发店里有两个,每当只有一个人在店里的时候,我就分不清哪个是哪个。昨天在我头上下功夫的是两个其中的一个,这个我可以负责任地说。
还是那样的不敬业,虽然已经是一个月过去了。在给我理发的忙里偷我的闲,指导实习小伙子吹发一次,接电话一次,还和另外两个实习生评论其他顾客的发型一次。
当时正好在播新闻联播。电视上说,开国上将吕正操追悼会在八宝山举行。
理发内三十多岁的女人说了:这人停了七天才火化,肯定是等着给钱呢,要不就是等着安排子女呢,反正是没解决事儿呢!
旁边一个实习生说,那么多领导人都去了,他们得随多少礼啊?

从前五天开始,每次吃完饭,女儿都要把自己的碗和筷单独送到水池子里。看着她一反常态的洋洋得意,我和LP都不知道她那空碗里卖的什么药。
昨天女儿心情好,主动地跟我索:知道我为什么那样做吗?
我老实地说我不知道。
女儿说:日本动漫里的孩子都这样,这是教给我们,从小要养成好习惯。
